Terms of Service

1. Who we are and what this agreement covers
Rentiqo ("Rentiqo", "we", "us", "our") operates a peer-to-peer rental marketplace (the "Platform") through our website and mobile applications (together, the "Services") that lets one user ("Lender") list an item for temporary rental to another user ("Borrower"). These Terms of Service ("Terms") are a legal agreement between you and Rentiqo governing your access to and use of the Services. By creating an account or otherwise using the Services, you agree to these Terms and to our Privacy Policy.
2. Eligibility and your account
- You must be at least 18 years old and able to form a binding contract to use the Services.
- You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
- You may sign in with a password or through a supported social login provider (Google, via Auth0). You are responsible for all activity under your account.
- We may suspend or terminate accounts that violate these Terms, provide false information, or are used fraudulently.
3. Identity verification
To unlock certain trusted-tier features, you may be asked to upload a government-issued ID (passport, driver's license, or national ID card) and enter a one-time code sent to your email or phone. We use automated document-text recognition to compare the name on your uploaded document against your profile — we do not verify document authenticity beyond this text match, and this process may occasionally reject a valid document or, in rare cases, be spoofed by a bad actor providing a matching but stolen document. Identity verification is a fraud-deterrence signal, not a guarantee, and does not by itself establish anyone's real-world identity to a legal standard.
4. Listings, rentals, and your responsibilities
- Lenders are solely responsible for the accuracy of their listings, the condition and legality of the item offered, and for having the right to rent it out.
- Borrowers are responsible for using rented items safely, lawfully, and in accordance with the rental agreement generated for each rental, and for returning items on time and in the condition received (normal wear excepted).
- Rentiqo is a marketplace connecting Lenders and Borrowers. Unless expressly stated otherwise, Rentiqo is not a party to the rental agreement between them and does not own, inspect, or guarantee any listed item.
- A rental contract, generated at the time of booking, sets out the specific terms (price, duration, condition expectations) agreed between the Lender and Borrower for that rental. Where these Terms and a specific rental contract conflict on marketplace-level rules (e.g. platform fees, dispute handling), these Terms govern.
5. Our role: an information and coordination platform only
Rentiqo is a platform that helps connect Lenders and Borrowers and gives them the tools — listings, contracts, handover check-ins, and notifications — to coordinate a rental themselves. We are not a party to the rental transaction, we do not inspect, own, insure, or guarantee any listed item, and we are not responsible for any profit, loss, damage, or other outcome you experience from renting out or borrowing an item through the Platform. Any decision to list, rent, lend, or borrow an item is yours alone, made using the information available to you on the Platform; Rentiqo's role is to provide that information and the coordination tools, not to guarantee any financial or practical result from using them.
6. Handover, condition evidence, and disputes
The Services support a photo/GPS-based handover check-in and check-out flow intended to create a shared, timestamped record of an item's condition at pickup and return. This process is provided to help resolve disagreements — it is evidence, not a guarantee of outcome. Either party may submit an insurance/damage claim after a rental; claims are reviewed using the evidence submitted and may be approved, rejected, or settled at Rentiqo's reasonable discretion under the applicable claim terms in effect at the time.
7. Fees and payments
Rentiqo may charge service fees on rentals, disclosed before you confirm a booking. Except as required by law or expressly stated in a rental's cancellation terms, fees are non-refundable once a rental is confirmed.
8. Prohibited conduct
- Listing illegal, stolen, dangerous, or counterfeit items.
- Circumventing the Platform to transact off-platform to avoid fees or safety features.
- Uploading someone else's identity documents, or otherwise misrepresenting your identity.
- Harassing, defrauding, or attempting to harm another user.
- Interfering with, reverse-engineering, or attempting to bypass the Services' security controls (including rate limiting and identity verification).
9. Notifications
By using the Services you consent to receive transactional notifications (push, email, and/or SMS where enabled) about your account, rentals, contracts, handovers, and claims. You can manage channel preferences in Notification Settings; some account-security and legal notices cannot be disabled.
10. Disclaimers and limitation of liability
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENTIQO DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND RENTIQO'S TOTAL LIABILITY ARISING FROM YOUR USE OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO RENTIQO IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Termination
You may stop using the Services and delete your account at any time from your profile settings. We may suspend or terminate your access for violating these Terms or to comply with law. Sections that by their nature should survive termination (e.g. disclaimers, limitation of liability) will survive.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you (e.g. via the in-app notification inbox or email) before they take effect. Continued use of the Services after changes take effect constitutes acceptance.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles, except where a user's local consumer-protection law mandatorily requires otherwise (which controls over this clause for that user).
Before filing a claim, contact us at rentiqo.co@gmail.com so we can try to resolve the issue informally. If we can't resolve it within 30 days, any dispute will be settled by binding individual arbitration under the American Arbitration Association's rules, rather than in court — except either party may bring an individual claim in small-claims court instead, and this Section does not require arbitration of claims that, by law, cannot be subject to a pre-dispute arbitration agreement. There is no class action, class arbitration, or representative action under these Terms; disputes are resolved individually.
Users located in India: nothing in this Section limits your rights under the Consumer Protection Act, 2019, including your right to approach a consumer forum in India.
